IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO.543 OF 2018 Anna s/o Fakirrao Kalatre Petitioner

Versus

The State of Maharashtra & others Respondents Mr.Vitthal G. Salgare, advocate for the petitioner. Mr.S.Y.Mahajan, A.G.P. for Respondents No.1 to 5. CORAM : R.M.BORDE AND K.K.SONAWANE, JJ.

DATE : 23rd February, 2018.

P.C. :

The petitioner raises challenge to the order dated 26.12.2017, issued by the Education Officer (Secondary), Zilla Parishad, Aurangabad, directing absorption of the petitioner in Amravati Division. The decision appears to have been taken in pursuance to the order passed by the Division Bench of this Court at Nagpur in Writ Petitions No.5059 of 2017 and 4684 of 2017 dated 27.11.2017. The reference to the aforesaid order in writ petitions also finds place in the impugned order dated 26.12.2017. If, at all, the petitioner has any grievance in respect of the order issued by the Education Officer, which is passed in pursuance to the order passed by the Division Bench of this Court at Nagpur, as referred to above, it would be open for the petitioner to avail of the remedies available in law. That, the request made by the petitioner, if allowed, would run contrary to the order passed at Nagpur Bench, which needs to be avoided.

{2} wp54318.odt In this view of the matter, no interference is called for. Keeping open an option to the petitioner to avail of the remedies available in law, petition is disposed of.
