Heard the learned Advocate for the petitioners. 2.

The petitioner has challenged an order dated 8th November 2024 passed by the learned 3rd Joint Civil Judge, Junior Division, Ahmedpur rejecting the application of the defendants for appointment of Court Commissioner.

From the record it is seen that, the Court has considered that already measurement is done in the year 2015 by the learned T.I.L.R.. The map is prepared by the T.I.L.R. and the same is also produced on record. This Court finds that since the TILR has already carried out the

Ethape ( 2 ) 51-WP-3494-2025 measurement and the same is on record, there is no case made out to appoint the commissioner. There is no serious challenge the measurement by the petitioners, who happens to the original defendants in the suit.

Considering above, this Court is not inclined to entertain the writ petition. Writ petition is, therefore, dismissed. No order as to costs. [KISHORE C. SANT, J.]
