The applicant claims to be franchisee whose period of franchisee has already come to an end. Hence,sought replacement of existing petitioner M/s G.T.L. Ltd. with that of M.S.E.D.C.L. in the petition.

Admittedly, the recovery in question in this petition is of the tenure during which the petitioner was operating under the franchisee agreement.

The clause contrary, in the franchisee agreement, to the right of recovery to be carried out by G.T.L. for the

-:(2):- said period, is not brought to the notice of this Court. In view of this, in my opinion, the application deserves to be rejected, as such rejected.
