The learned counsel for the appellant submits that the parties have settled the matter and that he would withdrew the Second Appeal No.391 of 1995. The parties are also present in the court.

The Second Appeal No.391 of 1995 is disposed of as withdrawn.

In the remaining two matters i.e. Second Appeal No.396 of 1995 and Second Appeal No.397 of

2 sa 391.1995+ 1995, the parties are same and present in the court. However, the advocate for the parties is not present and I am informed that the advocate is not regularly practicing before this court.

In view of the settlement between the parties and that the parties are present in the court, and that they confirmed that they have sold the suit property to the respondent by registered sale deed, the Second Appeal No.396 of 1995 and Second Appeal No.397 of 1995 are also disposed of.
