Heard the learned Counsel for the applicants, the learned A.G.P. for non-applicant no.1 / State and the learned Counsel for the non-applicant no. 2.

The offence was registered against the applicants at police station, CIDCO, Aurangabad vide Crime No.616/2020 for the offences U/Sec.406, 420 read with Section 34 of the Indian Penal Code, 1860.

Since, the applicants were apprehending their arrest they approached this Court by filing application for anticipatory bail bearing No.825 of 2020. In that proceedings the non-applicant

2 Cr.Appln.55.2021 no.2 herein / who is the original complainant filed an affidavit in which it is stated that she had already received the entire amount and she has no objection for grant of anticipatory bail. In view of that, this Court allowed the application. 4.

Today when the application was taken up, the learned A.P.P. has made a statement on written instructions from the office of police station, CIDCO, Aurangabad that the investigating agency has already filed "C" summery before the Court. 5.

In that view of the matter, the present application is allowed. The First Information Report i.e. Crime No.616/2020 registered with police station, CIDCO, Aurangabad for the offences U/Sec.406, 420 read with Section 34 of the Indian Penal Code, 1860 is hereby quashed and set aside. 6.

Criminal Application is accordingly disposed of.
