On 07/12/2022, we had passed the following order :- "1.

Shri. Aparajeet Ninave, the learned advocate, had tendered a circulation note on 06.12.2022 by mentioning at 10:30 AM that the petitioner desires to withdraw this petition. The matter was granted circulation for today and placed in the withdrawal category.

The learned advocate for the petitioner is Shri S. R. Barlinge. Shri Barlinge was heard on 10.02.2021 and while issuing notice, this Court has granted interim protection to the petitioner. Shri Barlinge submits that he has no knowledge as to whether, the petitioner desires to withdraw the petition.

Shri Ninave is apologetic that the 'no objection' certificate was not taken from Shri Barlinge, inasmuch as,

2642.21wp (2) a Vakilpatra has not been issued by the petitioner in his favour.

At the request of Shri Ninave, we are listing this petition on Friday, if he desires to file a Vakilpatra. 5.

Stand over to 09.12.2022 (Friday) in the passing orders category."

Today, the learned Advocate Shri Ninave, submits that the learned Advocate Shri. Barlinge has given his 'no objection'. The petitioner desires to withdraw this petition. 3.

In view of the above, this petition is dismissed, as withdrawn on instructions.

Needless to state, the protection granted to the petitioner, vide order dated 10/02/2021, stands vacated.
