This petition challenges order dated 21/10/2023 passed by learned Additional Sessions Judge, Biloli, in Criminal Appeal No.16/2023, thereby allowing appeal filed by respondent No.1 husband and setting aside order dated 09/08/2023 passed by learned Judicial Magistrate First Class, Degloor, below Exhibit-5 in PWDVA No.02/2017, granting interim maintenance to petitioner. 2.

Upon hearing learned advocate for petitioners and learned advocate for respondent, and considering the fact that trial Court is directed to decide PWDVA No.02/2017 on or before 10/05/2024, this Court is not inclined to go into merits of the challenge raised in present petition. When main matter is about to be decided by the trial Court, observations, if any, made in present matter would influence trial Court while deciding main proceedings. Hence, keeping rival contentions open, writ petition is disposed of. Trial Court to dispose of the matter.
