The petitioner, who is the plaintif in a suit brought for partition and separate possession, is assailing the order dated 07.10.2019, rendered by the trial Court, whereby defendant no.10 is permitted to pay costs, subject to which the "no written statement" order is set aside.

I do not see any reason to interfere with the order impugned in writ jurisdiction. The suit is for partition and separate possession and the rights of the litigants in immovable property are involved. It would be in the interest of all the parties if the controversy is adjudicated on merits. However, considering the

controversy, the trial Court is requested to expedite hearing of the suit.

Petition is disposed of.
