Mr. Suryawanshi, the learned advocate for the petitioner and Mr. Kadethankar, the learned advocate for the respondent No. 2 submit that, the order directing to add and implead owner of vehicle bearing registration No. MH-26/B-7909 as party respondent is assailed.

The learned counsel for the petitioner states that, the owner of vehicle No. MH-26/B-7909 has already died. 3.

In view of the said statement, the order of the learned
