We have heard the learned Advocates for the Petitioner and Respondent No.2/Director of Municipal Administration. It is an admitted position that the 7th Pay Commission recommendations were made applicable to the said Department from 01/01/2016. It is also undisputed that the Petitioner superannuated on 30/06/2016.

Respondent No.2 confesses that the original service book and the record of the Petitioner were with the said Respondent and which have been misplaced.

Considering the undisputed position, this Writ Petition is disposed off, with a direction to Respondent No.2 to ensure that the pensionary benefits are paid to the Petitioner as per the 7th Pay Commission recommendations, within 60 days from today, and all the arrears shall be calculated and paid to the Petitioner within a period of 90 days from today.
