Learned Advocate for the petitioner is challenging the order passed by the Additional Commissioner, Aurangabad in Appeal No.23 of 2019 dated 08.04.2019. Respective Advocates appearing for the respondent Nos. 4 and 6 raised preliminary objection that revision is maintainable against the order of Commissioner before the State Government.

Hence, considering that statutory alternate remedy is available to the petitioner, the writ petition is not maintainable. The petitioner, therefore, seeks withdrawal of the Writ Petition in order to approach the State Government by filing revision. However he makes a request that the Writ Petition was of the year 2020 and he has been

936-381-2020 -2protected by the order of status quo vide order dated 08.01.2020. 3.

In view of the above, in order to enable the petitioner to approach the State Government by filing second revision, status quo order is continued for a further period of two months. 4.

The time consumed in prosecuting the present writ petition be considered by the minister while passing order on delay condonation in Revision Application, if filed by the Petitioner. 5.

Writ Petition is disposed as withdrawn.
