The Civil Application has been preferred Applicanthusband seeking stay to the implementation of the order dated 14.03.2019, which was modified by this Court in Misc. Application No.07 of 2019, granting access of the minor child to the Respondent-wife on 1st and 3rd Saturday of every month for a period of 2 days and the child was required to be handed over to the applicant-father on the next day.

Learned counsel for the applicant submits that on 05.02.2023, there is an examination scheduled and as such seeks concession in respect of handing over the child on 04.02.2023. 3.

Learned counsel for the Respondent fairly concedes that since it is a question of examination, there is no objection if the

2 / 2 14ca1053-23 Respondent does not take access on 04.02.2023. In my opinion, there is no requirement to grant stay to the impugned order dated 14.03.2019, in view of this statement made by the learned counsel for the Respondent, which is made on instructions of the Respondent.

Civil Application stands disposed of in view of the statement made.
