DATE : 18.02.2021 ORAL ORDER :- Heard learned advocate Mr.Bhandari for the respondent no.2 from the Writ Petition and the learned advocate for the petitioner. 2] By the order dated 13/12/2017 passed in the Writ Petition the respondent Petroleum Companies were allowed to complete the process regarding selection of the candidates for L.P.G.Dealership, however, no orders were to be issued to the selected person/s.
( 2 ) ca1344-20 3] By this application, it is now being sought that though site for Navgaon Tq. Navapur, Dist.Nandurbar which falls under "Durgam Kshetriya Vitrak" category does not form part of the relief being claimed in the main Writ Petition, by way of abundant precaution the respondent no.2 seeks relaxation of that interim relief to the extent of allowing it to allocate the distributorship to the successful candidate.
4] Having heard both the sides, it transpires that in the Writ Petition no relief is being claimed in respect of location Navgaon, Tq.Navapur, Dist.Nandurbar.
5] As can be noticed from the orders dated 4/12/2018 and 11/12/2018, the interim relief has been modified few times so as to enable the respondent Petroleum Companies to go ahead with allocation of distributorship to successful candidates from Scheduled Tribe category, it would be appropriate to allow the application in terms of prayer Clause "B". 6] The Application is allowed in terms of prayer Clause "B" and disposed of. However, it is clarified that such appointment shall be subject to the final outcome of the Writ Petition.
