The proposal seeking approval to the appointment of petitioner on the payscale of a trained graduate teacher is rejected on the ground that the petitioner has not passed TET examination.

Mr Shirsath, learned Advocate for petitioner submits that now the management has posted the petitioner on the post of undergraduate pay-scale. The proposal is also submitted afresh. The respondent-Education Officer is not deciding the same.

We have also heard learned A.G.P. and learned Advocate for respondent no.3.

As fresh proposal has already been given (Page 26), the respondent no.3 shall decide the said proposal on its own merits, in accordance with law preferably within a period of four months.

Writ Petition disposed of. No costs.
