The applicants are seeking quashment of the Crime No. 103/2022, registered with Washi Police Station District Osmanabad for the offences punishable under Sections 323, 324, 326, 327, 452, 504, 506 read with Section 34 of the Indian Penal Code.

The learned advocate for the applicants submits that in fact the Court had not inclined to entertain the application on merit and had expressly indicated it but only with a view to explore the possibility of some amicable settlement, the notices were issued. However, there is no possibility of any settlement and the matter may be disposed of in terms of the order dated 16.10.2023.

The order dated 16.10.2023 reads as under :

"1.

Names of the applicants figure in the F.I.R. Overt acts have also been attributed to them and injury certificate 1/2

1011 APPLN 150 OF 2023.odt is also placed on record. As such, on merits we are not inclined even to issue notice.

It is informed that there is counter F.I.R. Only with a view to explore possibility of settlement between the parties, the matter stands adjourned to 10th November, 2023. If the informant comes before the Court and gives consent, then it would be considered."

In view of the statement made by the learned advocate for the applicants about there being no possibility of any amicable settlement, the application is dismissed.
