This second appeal has been admitted vide order dated 13.1.1998 without framing substantial question of law. On 26.7.2023 when matter was listed for final hearing, at the request of the learned counsel appearing for appellant, it was adjourned by way of last chance with rider that no further adjournment will be granted. On 13.12.2023 again matter was listed for final hearing. Request was made to adjourn the matter. This court passed detail order recording conduct of the appellant. However, with intention to protect interest of the litigant, last opportunity was granted and matter was adjourned with the rider that no adjournment will be granted on any count. Thereafter, on 6.3.2025 when this matter was listed before this Court, none appeared for the appellant. Looking to the previous order, matter is adjourned today and

fa 492.95.odt paced on board for dismissal. However, none appears for the appellant. Aforesaid conduct on the part of the appellant shows that he has no interest in the litigation. Inspite of several opportunities granted, no efforts are taken to argue the matter. Court is unnecessarily burdened to pass orders granting opportunities. Hence, Second Appeal stands dismissed for want of prosecution. Pending civil application, if any, also stands disposed of.
