IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO. 1766 OF 2017 BHAGWAT VINAYAK KEWADKAR

VERSUS

SONALI @ KALPANA BHAGWAT KEWADKAR AND ANOTHER ...

Advocate for Petitioner : Shri Shinde Shrikishan S.. Advocate for Respondent 1 : Shri M.S.Tour h/f Shri V.B.Dhage. ...

CORAM: RAVINDRA V. GHUGE, J.

DATE :- 20th September, 2017 Per Court:

The Petitioner/ Husband is aggrieved by an interlocutory order dated 30.11.2016 by which Respondent No.1 has been granted the interim maintenance of Rs.2000/- per month for herself as well as for her child.

The learned counsel for Respondent No.1 submits that HMP No.61/2015 has been dismissed in default.

The learned counsel for the Petitioner submits that an application for restoration has been filed and the same is pending. Prima facie, I do not find that the interim maintenance granted can be said to be exorbitant or likely to cause grave injustice to the Petitioner. Nevertheless, in the event, HMP No.61/2015 is restored,

*2* 901wp1766o17 the Petitioner would be at liberty to request the Trial Court to expedite the hearing of the said petition.

With the above observations, this Writ Petition is disposed of. kps (RAVINDRA V. GHUGE, J.)
