PER COURT :

By this application, the applicant/wife prays for restoration of the Miscellaneous Civil Application, which was dismissed on account of non supplying of a copy for issuance of notice to the respondent.

Considering the above, this application is allowed subject to the following directions :

(a) An amount of Rs. 500/- shall be deposited with the Government Medical College and Hospital, Aurangabad, through Medical Officer, High Court Dispensary, Aurangabad, either in cash or by Demand Draft (Demand Draft be drawn in the name of "Dean, Government Medical College and Hospital, Aurangabad Dengi Samiti") and

18CA1087.19 shall report compliance of this direction by producing a receipt of having deposited the amount, before the Registrar (Judicial) of this Court on/or before 29.01.2019.

(b) A copy of the Miscellaneous Civil Application shall be supplied on/or before 29.01.2019 for issuance of notice.

(c) Upon compliance of the above directions, the Miscellaneous Civil Application shall stand restored at the stage at which it was dismissed and notice shall be issued to the respondent/husband, returnable on 01.03.2019.
