Learned counsel for the respondent is absent. 2.

Learned counsel Mr. E. P. Sawant informs that sole respondent died. He is occupant of the pan stall, which was let out by the appellant to him. The subject matter i. e. pan stall is destroyed in the road widening. He had filed suit for perpetual injunction only. On instructions of his client, learned counsel submits that matter has become infructuous.

Suit was filed for perpetual injunction and subject matter is destroyed. Nothing remains to be adjudicated in the matter. Second appeal is disposed of as infructuous.
