Heard learned counsel for the petitioner.

The petitioner is unit working in development of software and providing it, it may not be necessary for us to refer to the grievance of the petitioner in detail. Suffice to say that the grievance is in respect of allotment of plots/Galas in IT park in software technology park, Chikalthana Industrial Area, Aurangabad. It is submitted that cetain plots/Galas though allotted, they are not in use, whereas the authorities are initiating action of eviction against genuine users of plots/Galas. It is also submitted that the direction be issued to respondents MIDC to evict the non genuine users from

( 2 ) the STPI park and allot these plots to the petitioners. Now as there would be certainly a dispute on these aspects and more particularly the petitioner has already approached the Regional Officer of MIDC, Aurangabad by way of representation dated 07.08.2018 and 24.10.2018, we are of the opinion to dispose the petition with direction to the authorities to decide the said representations. 3.

It is brought to our notice by the learned AGP that the competent authority would be the Chief Executive Officer of the MIDC and representation placed on record shows that the representation is made to the Regional Officer.

Mr.Talhar, learned counsel accepting this fact fairly submits that the petitioner would file comprehensive representation to respondent No.2 within two weeks, in case such representation is submitted by the petitioner to respondent Nos. 2 and 3 within two weeks, Respondent Nos. 2 and 3 to take appropriate decision on the representation, needless to state on merits of the representation, as expeditiously as possible and not later than 12 weeks from the date of representation.

With these observations, the writ petition is disposed of.

All the contentions raised in the petition and if such contentions are raised in the representation are kept open for the decision of the competent authority.
