The application of the petitioner for issuance of tribe certificate as belonging to Koli Mahadev (Scheduled Tribe) is rejected by the Sub Divisional Officer.

Mr. Patil, the learned Additional Government Pleader submits that, the petitioner has remedy of filing an appeal before the Scrutiny Committee.

In view of that, the writ petition is disposed of with liberty to the petitioner to file an appeal before the Committee. All contentions of respective parties are kept open. The Committee where the appeal would be filed shall consider the time spent in prosecuting the present writ petition. The writ petition is disposed of. No costs.
