Learned counsel for the respondents submits that during pendency of this Writ Petition, by judgment and decree dated 27.07.2004 passed by the Civil Judge, Junior Division, Omerga, the Regular Civil Suit No. 14 of 1996 came to be disposed off and even the appeal bearing Regular Civil Appeal No. 217 of 2004 preferred against the said judgment and decree passed by the trial court also came to be disposed off by the Additional District Judge, Omeraga by judgment and order dated 01.07.2005. Learned counsel submits that now the second appeal bearing Second Appeal No. 1614 of 2005 is pending before this Court.

In view of this, the Writ Petition preferred against the amendment carried out by the plaintiff in the original suit has become infructuous. The Writ Petition is accordingly disposed off. Rule discharged.
