It is informed that the debtor has presented a petition and the same is stated to be pending before the learned Single Judge being Writ Petition no. 8563/2013. It would be open for the petitioner to tender application seeking impleadment in the said writ petition as intervener. So far as instant petition is concerned, in view of challenge raised by the debtor which is pending before the learned Single Judge, no interference is called for. It would be open for the petitioner to move this Court after dismissal of writ petition pending before the learned Single Judge. With liberty as aforesaid, writ petition stands disposed of.
