ORDER :
1] Learned counsel appearing for the parties state that copy of the civil application has been served upon Shri S.R. Bodade, learned counsel appearing for respondent no.1.
2] With the consent of learned counsel appearing for the applicant and respondent nos.3 & 4, the order dated 5.1.2018 in Civil Application No.164/2018 is hereby recalled.
CA No.687 /18 - 2 - 3] Instead, Civil Application Nos.164/2018 and 687/2018 are disposed of by permitting Rajendra and Ushatai to withdraw a sum of Rs.3,00,000/- from out of the compensation amount deposited by the insurance company. Applicant - Priyanka is permitted to withdraw a sum of Rs.3,00,000/-. Priyanka, Rajendra and Ushatai shall file undertakings in this Court stating that such withdrawal shall abide by the final orders in this appeal. Such undertakings may be sworn before a Notary Public in Parbhani or Nanded District and the Registry is directed to accept the same.
4] Civil Application No.164/2018 as well as Civil Application No.687/2018 are disposed of in aforesaid terms.
5] The Registry to issue a demand draft of Rs.3,00,000/- (rupees three lac only) to Priyanka in her maiden name i.e. Priyanka Pundlikrao Chinchalkar. (M.S. SONAK, J.) ndk/c1711836.doc
