1) Heard. The order passed by the School Tribunal, Nasik in Appeal No.11/1997 passed on 28th November, 1997, is challenged by the School management in the present petition. This Court has granted stay to the operation of the impugned order, vide the order passed on 4th May, 1998. 2) Today, when the matter is taken up for hearing, learned Counsel appearing for the petitioner, tendered across the Bar a copy of the Certificate issued by the Principal, Kisan Vidya Prasarak Sanstha's Kisan Arts, Commerce and Science College, Parola District Jalgaon to the

WP No.1607/1998 effect that the respondent herein viz. Smt. Anita Dongarrao Mudavadkar is working in the Senior College run by the said institution as an Assistant Professor in Chemistry since 8th February, 1999. The learned Counsel submits that since the respondent has already secured the permanent employment and is serving with the said college since last 18 years, there seems no propriety in continuing with the present petition and in view of the subsequent development the petition may be disposed of.

3) Shri Shah, learned Counsel appearing for the respondent fairly submitted that apparently there appears no reason to dispute or disbelieve the Certificate tendered across the Bar and as such, the Court may pass appropriate orders.

4) Having considered the facts, as aforesaid, nothing remains to be considered in the instant petition and by passage of time, the same has become infructuous.

5) The petition stands disposed of being infructuous. Rule discharged.
