This is yet another petition alleging encroachment by private individual causing personal injury to the Petitioner. The person who is said to have caused the encroachment, is not arrayed as a Respondent. 2.

In view of the above, we do not wish to enter into disputed questions. The Petitioner may approach the District Collector, Ahmednagar and if his grievance is not redressed by the Statutory Authority, he may file a suit since he claims that his easementary rights and access to his house is allegedly. If the Petitioner files a proper representation to the District Collector, Ahmednagar, he may consider the same and initiate steps as is permissible in law.
