Mr. Amol Sawant, learned counsel appearing for the petitioner, on instructions, seeks to withdraw this Writ Petition 2.

Mr. S.D.Kulkarni, learned counsel for respondent no.4/original plaintiff states that at the time of admission of Writ Petition, this Court had directed the petitioner to deposit amount of Rs.10,000/- before the trial court. Learned counsel for the petitioner states that as per the directions of this Court the petitioner has already deposited amount of Rs.10,000/-.

Leaned counsel for the petitioner has no objection if the amount of Rs.10,000/- is withdrawn by respondent no.4.

Accordingly, respondent no.4/original plaintiff is at liberty to withdraw the amount deposited before the trial court.

The Writ Petition is disposed of as withdrawn. Interim relief stands vacated.
