The petitioner, who claims to be the L-4 bidder in the auction process undertaken by respondent No.1 in respect of providing PMC services for implementation of Ramai Aawas Yojana, in all probability as a after thought, is questioning the process and even the eligibility of L-1 to L-3 bidders, that too after lapse of enormous period. Since the date he was agitating being aware about their ineligibility on 11.06.2024 itself, he had raised an objection in respect of the eligibility of each of them. Subsequently, he seems to have waited in the wake of the development that the other 3 bidders were called upon to express if khs/Feb.2025/1571

- 2 - they were ready to match the offer of the L-1 bidder. It is thereafter also, the petitioner waited and is now questioning the eligibility after the work order was issued on 11.10.2024.

In the light of the aforementioned circumstances, it is evident that the petitioner has been taking chances at every stage of the auction process and is still seeking the powers of this Court under Article 226 to be invoked. We expressly refuse to invoke the powers and dismiss the petition.
