1) The application is filed for condonation of delay of 292 days caused in filing appeal by the acquiring body. Original claimants are served but nobody has turned up. In view of the contentions made in the application and the submissions made that time is required for obtaining certified copy, for processing the matter and for obtaining sanction at various levels, this Court holds that sufficient causes is shown. So the application is allowed. Delay is condoned.
2 CA 3343 of 2010 2) Notice in appeal. Learned AGP waives notice for respondent Nos.1 and 2. Notice to respondent No.3 made returnable on 29th July 2016. Call record and proceeding.
3) Heard learned counsel for the acquiring body on stay application. Subject to condition of deposit of entire amount of compensation within (8) weeks from today there shall be stay to the execution of the judgment and award. If the amount is not deposited in this time it is to be presumed that there is no stay. In those terms, the stay application is allowed and disposed of.
