On perusal of record and proceedings, it appears that Shri.Pradip Shahane and V.B.Golewar, Advocates, have filed pursis alongwith death certificate at Flag "A" stating therein that respondent no.2 Vitthaldas Kashinath Bajaj has expired on 29.05.2013. A copy of death certificate filed on record clearly indicates that Vitthaldas Kashinath Bajaj has expired on 29.05.2013. Thereafter, no steps have been taken by the appellant to file C.A. and to bring on record L.Rs. of deceased respondent no.2. Therefore, this court has no option than to pass following order.

ORDER

The appeal against respondent no.2 Vitthaldas Kashinath Bajaj stands abated.
