BENCH AT AURANGABAD WRIT PETITION NO.599 OF 2019 NAYAN MANOJ JANNADKAR THROUGH FATHR MANOJ BHAULAL JANNADKAR

VERSUS

THE STATE OF MAHARASHTRA AND ANOTHER Mr. G.K.Chinchole, Advocate h/f Mr. S.M. Vibhute, Advocate for the petitioner Mrs. R.P.Gour, AGP for the respondent/State.

CORAM : PRASANNA B. VARALE & S.M.GAVHANE,JJ.

DATED :

31.01.2019 P.C. :- 1.

Heard Mr. G.K.Chinchole, learned counsel h/f Mr. S.M. Vibhute, learned counsel for the petitioner. 2.

A limited grievance is raised in the petition. Learned counsel Mr.Chinchole appearing for the petitioner invited our attention to the documents placed on record and submitted that the petitioner is the student prosecuting his studies in ITI course, at ITI College, Station Road, Aurangabad and then application is submitted to the authority on 19.06.2018. The copy of the application is placed on record at Exhibit-A. The documents are also submitted to the authorities in the form of school leaving certificate and in the form of an affidavit, wherein the family tree of the petitioner is reflected. The learned counsel submitted that the petitioner also approached the Sub Divisional Officer with a representation/application on 18.12.2018 apprising the authority about the decision of this

( 2 ) wp599.19 Court.

3.

It is also submitted by the learned counsel that there is a Tribe Certificate issued in favour of the father of the petitioner and the copy of said certificate is also placed on record at Exh.B. Learned counsel thus submits that the application is pending before respondent No.2 for considerable long time, as such the petitioner is left with no choice but to approach this Court seeking directions to the authority. 4.

In view of the submissions of the learned Counsel on the backdrop of documents referred to above and as the learned Counsel was justified in raising the grievance, we are of the opinion that the petition can be disposed of at the admission stage. The petition is accordingly disposed of with directions to respondent No.2 to take a decision on the application of the petitioner and if the respondent No.2 finds favour with petitioner on his claim, to issue the certificate of 'Mannervarlu' Tribe as expeditiously as possible and not later than 12 weeks from the date of order of this Court.

5.

With these directions the petition is disposed of.
