Heard the learned counsel for the applicant and the learned APP for the respondent-State.

The prime allegations against the applicant was that his deceased wife learnt about his extra marital relationship. The general allegation of demand of money has also been made against the applicant. Two days before the incident, the deceased was taken to one Dargah and some black magic was played with her and then, two days thereafter, the deceased found died in her house. The offence under Sections 306, 304B, 498-A, 323 read with Section 34 of the IPC along with other acts have been registered. The FIR reveals that on 25.05.2022, the applicant called the first informant and told him that she is

behaving abnormally. So the complainant promised him that they would come next day, but they did not come. The cause of death of the deceased is "Asphyxia due to hanging". Considering the allegations levelled against the applicant and completion of the investigation, the Court is of the view that it would be inappropriate to keep the applicant for indefinite period behind bar. Therefore, the applicant deserves bail. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant IMRAN MAHEMOOD QURESHI be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in Crime No.113 of 2022, registered by Police Station Hasnabad, District Jalna, for the offences punishable under Sections 306, 304-B, 498-A, 323 read with Section 34 of the IPC and Section 3 of the Maharashtra Prevention and Eradication of Human Sacrifice and other Inhuman, Evil and Aghori Practices and Black Magic Act, 2013 on the

condition not to tamper with the prosecution witnesses.
