As per the affidavit filed by the Education Officer two posts are vacant with the respondent institution. According to Mr. Barlinge, learned Counsel for respondent Nos. 3 and 4 one Mr. Sonawane is already appointed from 1999 as an Assistant Teacher.

Even assuming the same to be true still there would be one post vacant. We are not entering into the legality or otherwise of the appointment of said Mr. Sonawane as still one post is shown vacant. Mr. Barlinge and Mr. Sandanshiv, learned Counsels appearing for the respondent No. 3 submit that if the Education Officer is ready to consider and grant approval to the appointment of petitioner, the respondent Nos. 3 and 4 are ready to issue appointment order to the petitioner.

The respondent Nos. 3 and 4 shall issue appointment order to the petitioner as contended by them and the proposal shall be sent for approval. The appointment order shall be issued within a period of 15 (fifteen) days from today.

The Education Officer shall thereafter consider the proposal that would be forwarded for approval on its own merits. 5.
