Issue notice to respondent. Learned A.P.P. waives service of notice for respondent - State.

Learned Counsel for petitioner argued for suspension of substantive sentence. This Court has gone through the judgment delivered by the Judicial Magistrate, First Class, Lohara and also Sessions Court, Omerga. The petitioner is convicted and sentenced for the offences punishable under Section 354 and 452 of the Indian Penal Code. The petitioner is sentenced to suffer imprisonment for six months and fine 1 / 2

908_REVN1217.odt of Rs.1,000/- is imposed. The record produced shows that fine amount is deposited on 29th December, 2011. This Court holds that the substantive sentence needs to be suspended.

Criminal Application No. 189 of 2017 is allowed. Substantive sentences are hereby suspended. The applicant is to be released on bail on furnishing of P.R. bond of Rs.25,000/- ( Rupees Twenty Thousands Only ).

Criminal Revision Application is to be listed on 17th February, 2017. Call for record and proceedings.
