The petitioner is imposed penalty of Rs.9,50,000/- on the ground of illegal excavation. Neither the petitioner in the present writ petition is challenging the order of penalty nor has filed any appeal against the order of penalty. The petitioner in the present writ petition is only claiming release of his vehicle.

As the penalty is already imposed upon the petitioner, it is for the petitioner to take steps to assail the same in accordance with law. The petitioner may also take appropriate steps with regard to the release of the vehicle as is permissible under the provisions of Section 48 of the Maharashtra Land Revenue Code, 1966.

Writ Petition is disposed of. No costs.
