PER COURT :- Heard learned Counsel appearing for the applicants and learned Counsel appearing for the respondent Insurance Company. Perused the impugned Judgment and award and the grounds of objection raised in exception to the said Judgment and award.

The learned Counsel for the respondent Insurance Company submitted that relying upon the income tax returns submitted by the deceased of the period prior four years of his death, the Tribunal has assessed the amount of compensation. In view of the submission made and after having considered grounds of objection raised in exception to the impugned Judgment and award, I deem it appropriate to pass the

{2} CA 733 OF 2019 following order:-

ORDER

I) The applicants are permitted to withdraw 50% of the deposited amount on submitting an undertaking to the satisfaction of the Registrar (Judicial) of this Court. II) Balance 50% of the deposited amount be invested in Fixed Deposit Receipt in any Nationalized Bank for the period till disposal of the appeal. III) Civil Application No.733 of 2019 stands disposed of.
