Heard learned Counsel for the applicant, learned Counsel holding for Mr. Dande for respondent No.1 and learned A.G.P. for respondent No.2.

The applicant seeks direction to the Acquiring Body to deposit in this Court the remaining 50% amount of compensation awarded by the Reference Court. According to the

(2) CA No.2885/2019 applicant, while granting interim stay, this Court had directed to deposit 50% amount of compensation. However, the remaining 50% amount is yet to be deposited by the Acquiring Body. 3.

However, I do not find any reason to issue direction to the Acquiring Body to deposit the remaining 50% amount of compensation in the Court. Otherwise also, in connected First Appeal No.1733 of 2017 Division Bench of this Court has already rejected similar prayer of the claimant. Therefore, this Application being devoid of merits, is dismissed. 4.

Place the First Appeal on 28 June 2019.
