The Petitioners' Appeal under Section 255 of the Maharashtra Land Revenue Code, is before the Appellate Authority. The Presiding Officer has been appointed around six months ago and is routinely hearing the matters. This Petition was filed since the Presiding Officer was not available, at the relevant time.

In view of the above, the learned Advocate for the Petitioners submits that the Petitioners would prosecute their pending Appeal.

As such, this Petition is disposed off. The ad-interim protection granted on 12.01.2023, shall continue upto 15.02.2024. The Petitioners are at liberty to approach the Appellate Authority and seek orders on their interim application. After 15.02.2024, the protection granted by this Court would lose it's efficacy and the Appellate Authority would decide the interim application on it's own merits.
