The petitioner is challenging decision taken by the State Government to grant certain financial benefits in favour participants of 64 Lift Irrigation Schemes in Dhule and Jalgaon districts. The petitioners contend that they are similarly situated, however, they have been excluded from the benefits accruable under the Scheme. The Scheme was formulated in 2009 and the benefits were extended to participants of the 64 Lift Irrigation Schemes.

Apart from delay and laches, the petitioner cannot claim the benefits as a matter of right. The administrative decision taken by the State Government, for extending benefits to a particular class, cannot be questioned by the petitioner inasmuch as, no hostile discrimination from amongst the same class has been pointed out.

The petition is devoid of substance and hence stands rejected.
