The petitioner seeks leave to withdraw this petition so as to prefer a proper application with due compliance of the legal requirements as is observed by the learned Trial Court in paragraph 3 of the impugned order dated 02-09-2013 passed below Exhibit 74 in Special Civil Suit No. 99 of 2011. The petitioner submits that he is supported by order of this Court reported at 2009 (1) ALL MR 677 in the matter of Satyanarayan Ramnarayan Totla & Anr. Vs. Rahul Hiralal Munot & Anr.
