1] Heard learned APP for the applicant.

2] Perused the findings recorded by the trial Court. Prima facie, it appears that the evidence in the nature of school record about the date of birth of the victim girl was not properly considered by the trial Court. In that view of the matter, this is a fit case for admission.

Cr.Appln.199/15 - 2 - 3] The application is allowed in terms of prayer clauses (A), (B), (C) and (F). Action u/s 390 of the Code of Criminal Procedure, 1973, to follow before the Sessions Court, Ambejogai.

4] Admit the appeal.
