3] It is an admitted fact that the amount of Rs.25,000/- awarded under Section 140 of the Motor

4] In that view of the matter, at the request of both the sides, present appeal is disposed of without any order on merit, with no order as to costs.
5] Learned Tribunal is directed to consider the issue under challenge, at the stage of deciding the main application under Section 166 of the Motor Vehicles Act. Learned Tribunal is requested to hear the main petition expeditiously.
6] Record and Proceedings be remitted back to the learned Tribunal.
