Learned APP, on instructions in writing from the Investigating Officer, submits that the prosecution has examined all the witnesses and the matter is now posted on 28.03.2022 for arguments.

Learned counsel for the applicant submits that meanwhile, the co-accused, who was absconding, came to be arrested and in view of the same, there may be a delay in trial even though the case is posted for hearing the arguments. Learned counsel submits that all the prosecution witnesses have turned hostile and as such there is no case against the applicant-accused.

Even if the co-accused came to be arrested during pendency of the case, and according to the learned counsel for the applicant, if all the witnesses have turned hostile, in my opinion, the trial court will not take much time to record evidence of the prosecution witnesses again to the extent of the said co-accused. In view of the same, the trial court is hereby directed to dispose of the case as expeditiously as possible, preferably within a reasonable time. 4.

The Bail Application is accordingly disposed off. (V. K. JADHAV, J.) vre
