The learned counsel for the Zilla Parishad submits that, the petitioner is seeking promotion and has alternate remedy under Rule 14(D) of the Maharashtra Zilla Parishad District Services (Discipline and Appeal) Rules.

In the light of that, though Mr. Mundhe, the learned counsel for the petitioner sought to canvass submissions on merits of the matter, we are not inclined to consider the same. The writ petition is disposed of with liberty to the petitioner to avail the alternate remedy. All contentions of respective parties are kept open. No costs.

In case such an appeal is filed by the petitioner, then the respondent No. 3 shall consider and decide the appeal on its own merits, expeditiously and preferably within a period of six (06) months from the date of receipt of appeal.
