Mr. Jadhavar, the learned counsel for the petitioner submits that, the petitioner has been admitted in B. A. M. S. course from reserved category i. e. S. T. category. The proposal has been forwarded by the college to the University, however, on account of lack of validity certificate the University is not accepting the same. The validation proceedings in respect of the Tribe Claim of the petitioner is pending.

Mr. Bayas, the learned counsel for the respondent No. 4 accepts that proposal is received, but as validity is not submitted the same is not rightly considered. 3.

It is not disputed that, validation proceedings in

2 wp 817.16 respect of tribe claim of the petitioner is pending since 2013. It is for the Committee to decide the same. 4.

Considering the above we pass the following order. 5.

The Committee shall decide the validation proceedings in respect of the Tribe claim of the petitioner expeditiously and preferably within a period of nine (9) months from today. The petitioner shall cooperate in expeditious disposal of the said proceedings. The petitioner shall appear before the Committee on 04th April, 2016. 6.

The respondent Nos. 3 and 4 shall not refuse to accept the examination form of the petitioner and shall not refrain the petitioner from prosecuting further studies only on the ground that validation proceedings are pending. The respondent Nos. 3 and 4 can take further action in tune with the judgment delivered by the Committee. The writ petition is disposed of. No costs.
