PER COURT :- 1.

When the present matter is taken up for hearing, it is brought to my notice that in connected appeals, 50% amount was permitted to be withdrawn on submitting an undertaking and further 25% amount on furnishing a solvent surety, the same order is sought in the present application. In view of the above, following order is passed, -

ORDER

i.

The applicants are permitted to withdraw 50% of the deposited amount on submitting an undertaking to the satisfaction of Registrar of this Court.

ii.

The applicants are further permitted to BDV

IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD withdraw 25% of the deposited amount on furnishing solvent surety/security in the like amount to the satisfaction of Registrar of this Court.

iii.

Balance 25% amount be invested in FDR of any nationalized Bank for the period, till disposal of the appeal.

iv.

Civil application for withdrawal of the amount stands disposed of.
