Learned APP submits that investigating officer has informed him that he has sought permission of his superior to file 'A' summary in the present matter. After the permission is received 'A' summary will be filed in Trial Court. 2.

In view of said statement and considering the fact that appellants are arrested on 11.12.2023, appeal deserves to be allowed. Hence, the following order:

ORDER

(I) Criminal Appeal is allowed.

{2} 924-APEAL-34-2024 (II) Order dated 29.12.2023, passed by learned Sessions Judge, Hingli, in Bail Application No. 658 of 2023, is hereby quashed and set aside.

(III) Appellants be released on bail in connection with Crime No. 566 of 2023, registered with Hingoli Rural Police Station, Dist. Hingoli, for offences punishable under sections 302, 323, 143, 147, 148, 149, 506 of the Indian Penal Code and under section 3(1)(r), 3(1)(s), 3(2)(va), 3(2)(v) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, on executing P.B. and S.B. of Rs. 15,000/- each, with one surety in the like amount.

(IV) Appellants shall not influence the prosecution witnesses.
