Petitioner is aggrieved by order passed by learned Additional Sessions Judge, Aurangabad, below Exhibit-161 in Sessions Case No.236/2017, thereby rejecting is application for calling the station diary and Muddemal register. 2.

Upon hearing learned advocate for petitioner and learned Additional Public Prosecutor for State and on going through application Exhibit-161 filed by petitioner, it appears that vague application is filed by petitioner without laying foundation or making up ground for calling station diary and Muddemal register. Petitioner is yet to cross-examine investigating ofÏcer. 3.

In the light of aforesaid facts, writ petition is disposed of by granting liberty to petitioner to file application for calling station diary and Muddemal register during cross-examination of investigating ofÏcer. If such application is made, the trial Court shall consider it on it's own merits without being influenced by order impugned in present petition.
