By this application, the applicants pray for condonation of delay of 1077 days caused in filing the appeal challenging the award passed by the Tribunal under the provisions of Motor Vehicle Act.

Though the notice of this application is served upon the respondents, none appears.

Mr. Mayure, learned Advocate appearing for the applicants invites attention of this Court to the reasons stated in paragraph nos.3 to 7 of the application to contend that the delay is not intentional. It has been occasioned because of prevailing circumstances.

Having considered the reasons as stated in the application, which are uncontroverted, the cause is made out to condone the delay. Hence, the following order:-

ORDER

a.

Civil Application is allowed.

b.

Delay of 1077 days caused in filing the appeal is condoned. c.

Appeal be registered subject to removal of office objections, if any.

d.

Civil Application is disposed of.
