The petitioner is challenging the auction proceedings conducted by respondents no. 1 and 2 under the provisions of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002.

The petitioner has a remedy U/Sec. 17 of the said Act. The petitioner shall avail the alternate remedy. If the Presiding Officer is not available, then the petitioner may seek circulation before the In-charge Court and if the circulation is not granted, then the petitioner may approach this Court.

With the aforesaid observations, the writ petition is disposed of. No costs.
